Messaging terms

In short. When your business texts through Presence, you are the sender: text only people who agreed, say who you are, and stop when they say stop. Presence enforces the basics for you, and the carriers enforce the rest. Part B is wording you can give your customers.

Part A forms part of the Terms of service between Redstone Castle LLC and each customer that uses texting, and adds detail to Section 9 of those Terms. Words with capital letters have the meaning given in the Terms.

Part A. Rules for businesses that text through Presence

A1. Registration

US carriers require every business that texts from an ordinary local number to register its business and its messaging campaign. You do this once, on the texting form in Settings. From your answers Presence writes the campaign description, how people agree, sample messages and the HELP, STOP and sign-up replies, and submits them through our carrier, Telnyx, to The Campaign Registry and the carriers. The registration Presence makes is for a small business texting its own customers, at low volume, about the topics you choose: customer care, appointment and account updates, job and delivery updates, and offers and promotions.

  • Everything you put on the form must be true, and must describe what you actually send.
  • The carriers decide whether to approve, and may take days or weeks. They may ask for changes or refuse, and may later suspend a registration.
  • Carrier fees are passed on at cost, as set out in Section 6.4 of the Terms and shown on the form before you agree: $19.50 to register, then $1.50 a month ($18 a year on yearly plans), $15 for each new campaign review and $4.50 for each correction of business details. Texts themselves are included in your plan.

A2. Consent

  • Before you text anyone, have the consent the law requires for that kind of message. Marketing texts, such as offers and promotions, usually need prior express written consent.
  • Wherever someone agrees, show them the disclosure in Part B, word for word or with the same content.
  • Record each person’s consent in Presence, with when and how it was given. Presence will not send to anyone without recorded consent or who has opted out.
  • When someone texts your number first, Presence treats that as permission to reply within that conversation. It is not consent to send them marketing.
  • Do not make agreeing to texts a condition of buying anything.
  • Keep your own records of consent for as long as the law requires. They are deleted from Presence when your account closes.

A3. Opting out and help

  • Presence stops texts to anyone who replies STOP, STOPALL, UNSUBSCRIBE, CANCEL, END or QUIT, or who asks in plain words, such as “please stop” or “remove me”, and sends one confirmation. Only their own START or UNSTOP restarts texts.
  • Presence answers HELP and INFO automatically with your business name and how to reach you.
  • If someone asks you to stop in any other way, such as on a call or by email, record the opt-out in Presence promptly, and in any case within the time the law allows.

A4. What you send

  • Your first text to each person names your business and says how to stop. Presence adds both if you leave them out.
  • Send texts only about the topics in your registration, and only from your business to people who deal with it. Do not text on behalf of another business.
  • Link only to your own website, and only if your registration says your texts contain links. Presence refuses public link shorteners such as bit.ly, because carriers block them.
  • Respect the calling and texting hours that apply where the person you are texting is.
  • Presence allows up to 2,000 texts in any 24 hours for each business, the most carriers allow for this kind of registration.

A5. Content the carriers do not allow

Carriers refuse or block texts, and suspend registrations, for content in these categories. You must not send it through Presence:

  • sex or adult content; hate speech; alcohol; firearms or weapons; tobacco, vaping or cannabis, including CBD;
  • third-party lending, payday loans, debt collection, debt relief or consolidation, credit repair, and high-risk financial services such as cryptocurrency promotion;
  • lead generation, affiliate marketing, or anything that passes on people’s numbers or consent to another business;
  • gambling, sweepstakes or prize offers, and get-rich-quick, work from home or multi-level marketing schemes;
  • illegal drugs, and prescription drugs without the licences the law requires;
  • political or election messages, which carriers require to be registered separately;
  • phishing, fraud, deception, or anything else unlawful or forbidden by the Acceptable Use Policy.

A6. Delivery and carrier action

  • We cannot promise that any text will be delivered or delivered on time. Carriers may filter, delay or block texts without telling us why.
  • Do not use Presence texting for emergencies or anything time-critical, or rely on it to receive one-time verification codes.
  • Carriers may suspend your registration or number, and may charge penalties for texts that break their rules. You are responsible for penalties your texts cause.
  • We may pause texting on your account to protect our carrier relationships and other customers, as the Terms allow.

A7. Policy pages we host for you

Carriers require a privacy policy and texting terms in your business’s name. If you do not have your own, you can choose on the texting form to have Presence publish them for you. They carry your business name, legal name, email address, business number and city, state and country, and follow Part B. You are responsible for making sure they are accurate and match what you do.

A8. Privacy

How Presence handles texts and consent records is in our privacy policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

Part B. Program terms for your customers

This is wording your business can use where people agree to texts and in your own texting terms. Replace the words in square brackets. It matches what Presence sends to the carriers for your registration, so if you change it, keep the same content.

B1. Where people agree

On a web form, put this next to a separate, unticked checkbox for texts, with links to your privacy policy and texting terms. Read it aloud when someone agrees by phone, and print it next to the mobile number box on a paper form.

B2. Texting terms

  • Program: texts from [Business name] about [the topics you chose], sent from [your Presence number].
  • How often: message frequency varies with your dealings with us.
  • Cost: message and data rates may apply, from your mobile carrier. [Business name] does not charge for texts.
  • Stopping: reply STOP at any time. We confirm once and send nothing more unless you reply START.
  • Help: reply HELP, email [your email address] or call [your Presence number].
  • Carriers are not liable for delayed or undelivered messages.
  • Agreeing to texts is not a condition of buying anything from us.
  • Privacy: your mobile information will not be sold or shared with third parties or affiliates for marketing or promotional purposes. See [link to your privacy policy].

B3. The automatic replies Presence sends

  • After STOP: “[Business name]: you will not receive any more texts from us. Reply START to sign up again.”
  • After HELP: “[Business name]: for help, call [your number] or email [your email]. Msg frequency varies. Msg & data rates may apply. Reply STOP to opt out.”
  • After START: “[Business name]: you are signed up for texts about [the topics you chose]. Msg frequency varies. Msg & data rates may apply. Reply HELP for help, STOP to opt out.”
